In selecting a tenant, there are also laws that one must abide by in not discriminating against a protected class in Massachusetts. What are these protected classes?

- Race
- Physical or mental disability
- Color
- Religion and creed
- Age
- National origin
- Sex
- Sexual orientation
- Ancestory
- Familial status
- Marital status
- Source of income
- Veteran status

## Legal Reasons to Refuse to Rent

If you feel you are justified in refusing a tenant, we recommend speaking with an attorney. Typically, you can refuse based on poor credit history or insufficient income. Additionally, families with children may be legally denied renting in an owner-occupied two family house or in some situations where an elderly person resides.
